This agreement is between Tegan Johnson Photography (“Photographer”) and the client booking a session (“Client”).
By completing your booking, you agree to the following terms, you also acknowledge and agree to our Privacy Policy, which explains how your personal information and portrait images are collected, stored, and used.
1. Session Details
• Sessions are short, scheduled portrait sittings designed to capture a small number of beautiful images of each child.
• Bookings are made within a specified one-hour session window.
• Multiple families may be booked within the same session window and are generally photographed in the order they arrive.
• Arrival time within your booked session window is flexible.
• If you arrive outside your booked session window, the Photographer cannot guarantee that you will be able to be accommodated.
• Session flow may vary depending on the age, mood, and cooperation of children attending.
• Late arrival within your booked session window may reduce the variety of images captured.
2. What’s Included
• A short portrait session with Tegan Johnson Photography
• An online proofing gallery containing the best images from your session
• The number of digital images included with your booking (as advertised for the event)
• Additional images may be purchased from your gallery
Final galleries are typically delivered within 7 days, though delivery times may vary slightly during busy periods. Online galleries will remain available for 30 days unless otherwise advised. Clients are responsible for downloading and backing up purchased images during this period.
3. Rescheduling & Cancellations
Sessions are offered on specific limited dates and times.
• Bookings are generally non-refundable, except where required under New Zealand law.
• One complimentary reschedule is permitted up to 3 hours before the scheduled session start time, subject to availability.
• Further changes may be offered at the Photographer’s discretion.
• If no suitable alternative time is available, your booking may be converted to a studio credit valid for 6 months.
• Failure to attend without notice may result in forfeiture of your booking.
• If the Photographer must cancel due to illness or unforeseen circumstances, an alternative session time, credit, or refund will be offered where appropriate.
4. Client Responsibilities
• Children should be dressed and prepared for their session.
• The Photographer will make every effort to capture beautiful images, however cooperation from children and adults is essential.
5. Session Limitations
These sessions are designed to be quick, simple portrait experiences.
Because of the short format:
• Specific pose requests may not be possible
• Extended combinations or large groups may not be accommodated
• Image variety may be limited if children are unsettled or arrive near the end of the booked session window
The Photographer will always aim to capture the best possible images within the session format.
6. Photographer’s Style & Image Selection
The Client acknowledges that they are booking based on the Photographer’s artistic style and editing approach. Final image selection, editing, and delivery are at the Photographer’s discretion.
7. Copyright & Image Use
(NZ Copyright Act 1994)
All photographs remain the copyright of the Photographer.
The Client acknowledges that this photography session is not treated as a commissioned work for the purposes of section 21(3) of the Copyright Act 1994, and that full copyright in all images remains with the Photographer.
Clients receive a personal-use licence for their purchased images which allows:
• Printing for personal use
• Sharing on social media
• Personal, non-commercial use
Images may not be altered, sold, or used commercially without written permission. RAW files are not provided.
8. Image Use by the Studio
Images from your session will only be used for studio marketing purposes where you have selected “Yes” on the booking form in response to:
“Are you happy for me to use a small selection of images from this session for studio marketing purposes (social media, website, and portfolio)?”
If you select “No”, your images will remain private.
9. Liability
The Photographer takes all reasonable care to provide a safe and professional environment.
To the extent permitted by law, the Photographer is not liable for circumstances beyond reasonable control including illness, equipment failure, accidents, studio disruptions, or unforeseen events.
In the unlikely event of total photographic failure or loss of images, liability is limited to the amount paid for the session.
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993.
10. Agreement
By completing your booking, you confirm that you have read, understood, and agree to these terms.
